Dear Mr. Farmer,

This letter is in reference to the parole hearing you chaired at the SACCO Unit on December 7, 2005.

During my parole hearing on this date, it seemed to me that you, and Deputy-Commissioner Garner-Easter as well, made a genuine effort to give me a fair hearing. For the most part, and in spite of severe shortcomings with the physical method we were forced to rely on for communication, I feel that you conducted the hearing in as professional a manner as possible under the circumstances. This made it doubly shocking for me when the course of my hearing was derailed by a matter I was not – and speaking to the point of this letter, I could not have been – suitably prepared to address.

My purpose in writing this letter is to make a formal request to the Board of Parole Hearings, through your office as Chief Counsel for the BPH and presiding Commissioner for my December 7th parole hearing:

I respectfully request that my hearing be reconvened for the limited purpose of allowing me an opportunity to respond properly to information that was introduced, much to my surprise, while the hearing was in progress. From my point of view the hearing was fair and on track up to that point; I ask only for the opportunity to appropriately address the one issue, keeping the current documentation and record of the hearing intact. If the procedures of the BPH do not permit a hearing to be reopened, in lieu of this I request that a new hearing be ordered.

I understand that the Board of Parole Hearings no longer has an administrative appeal process. Another BPH commissioner explained to me, however, that under extraordinary circumstances, such as an incomplete record or a gross technical error of some sort, a new hearing will be ordered. It is my belief, and my hope, that the extraordinary circumstances that occurred during my hearing are sufficient qualification for such relief.

The document upon which the outcome of my hearing pivoted, resulting in denial of parole, was – to the best that I’ve been able to determine – a computer printout of a portion of a page on a website. This document was apparently attached to a letter that had been placed in the confidential section of my CDC records. While the letter legitimately qualifies (presumably) for placement in the confidential file, it is my belief that the computer printout attached to it – because it was derived from a publicly accessible website – does not. Again, it was the printout from the website, not the letter, that the panel relied upon in denying parole.

This contravenes one of the most basic BPH regulations, the one specifying that a prisoner will be provided with ample opportunity (a minimum of ten days prior to the hearing) to review all non-confidential information that the hearing panel may rely upon in arriving at a decision.

I did not learn of the document at issue until midway into my hearing. Even then, due in large part to the limitations of the telephonic equipment (I was able to understand only about eight words in ten over the speakerphone), it was nearly impossible to have some sense of what you were looking at and the effect it was having on the course of my hearing. Had I been advised as to the nature of the information in advance of the hearing as procedure enjoins, I could have prepared a response that may have resulted in a vastly different interpretation than the one you arrived at.

For a person in my position, it is difficult to resist leaping to the suspicion that someone may have contrived to attach non-confidential information to a confidential letter as a way of circumventing the procedure. It’s not much of a leap, actually. I would be hard pressed to think of a better way to obfuscate the issues for the hearing panel, while putting me off balance and ill prepared to respond effectively. Of course, this is only speculation. I do wish to avoid getting hung up in a side issue. The only reason I mention this is because it could go to the veracity of the information itself, and may bear some looking into on that point alone.

Speaking to the information itself, it was designed to be misleading. Although I’ve not actually seen the document, as you know, from what I’ve gathered it comprises pieces of a web page that were assembled in such a way as to lead to the most prejudicial interpretation possible. Given that the larger context was omitted, it is understandable that you might arrive at the conclusion you did. However, basing an honest decision on dishonest information does not add up to a fair result.

Moreover, the interpretation drawn from this misleading information lacks any basis in fact. As a musician/composer, a visual artist, a writer, and a technologist, I have accumulated a fairly extensive history of having produced, and published, work in various fields of endeavor. Over the considerable number of years that I have been engaged in these activities, I have done so in conformance with institutional rules, and I have never attempted to trade on the Manson connection or exploit any criminal notoriety for personal gain. I have long held the belief that doing so, or authorizing anyone else to do so in my name, would be unethical.

One thing I find particularly troubling about the record of my hearing is the way in which the misleading information came to be insinuated into the hearing process. Early in the hearing (pg. 11 of the transcript) both you and Ms. Garner-Easter stated that there was recent confidential information in my case file, but that it did not appear to be anything you would base your decision on. Then, at about the middle of the hearing (pg. 74), Deputy D.A. Patrick Sequeira interjected to specifically bring your attention to the inflammatory web site information that was attached to the confidential letter. Mr. Sequeira’s personal knowledge of specific information in the confidential file is, to say the least, a puzzling irregularity. It has always been my understanding that both a prisoner’s attorney and the attending county D.A.’s representative participate in parole hearings in the capacity of witnesses, and are not actually considered to be functioning members of the hearing panel. Unless there has been some change in the regulations that I’m unaware of, neither legal counselor is permitted direct access to the confidential records without a court order.

I’m sorry that I did not have the wits to respond better when the direction of my hearing went on this unexpected tangent. I regret also that I did not request a postponement for a few months so that my attorney could attend the hearing. The inability to see what you were looking at, or to hear properly, or even to have the benefit of advice from an advocate who was in the hearing room, put me at an extreme disadvantage.

As it was, I did not fully comprehend the nature or import of the document that became the focal point of the hearing until you rendered the panel’s decision. And of course, by that time it was too late for me to speak to it.

Please allow me an opportunity to properly address the significant concerns you candidly expressed at the end of the hearing. In behalf of not only myself but of all my loved ones and friends who want very much to believe that the system can work, and that there is some hope I will be allowed to join them one day, I beseech you to reopen my hearing for this limited purpose. While doing so may not yield a different end result, it is likely that it will at least be based on more reliable information.

Its a very moving statement but unfortunately dealing with the system is beyond reason. Its political.

California is hysterically trying to deal with crime. An example is the three strikes initiative.

I would like Bobby to see daylight but I would be almost as shocked as when the OJ verdict was read.

From what I understood it's got to do with an exposition of Bobby's art in an art gallery. His bio was on that website and briefly mentions the fact he's in jail and the name of Charles Manson - which is logical IMO.

Some paintings Bobby made (and which were included in that exhibit) depict nude women and the DA felt it necessary to point this out (probably printed it out too) and on top of that he came up with the ridiculous story that Bobby uses Manson in order to display his work. The gallery didn't advertise Bobby's exhibit with "Former Manson follower exhibits his art" so IMHO the DA's claim is a large pile of bullshit.

Same here. I find this action by the DA utterly vile (my favorite word at the moment). They couldn't find anything to keep him in jail, and apparently this sneaky action was all they could come up with in order to get him sent back to jail. Get a grip, let the man get his release if he deserves it!

Bobby's letter is very good, I really hope they'll give him a chance to give his side to the story. The board seemed very fair and honest (and willing to consider his release, which is already quite something) so I have hope. I'm an optimist, I know :)

I too wish Bobby luck. Forty years, man, that's a long time. His crime was a shame, but forty years (give or take a couple) seems extreme. I think it's true, he will forever be linked to CM. This is what will, and has held him back.

You know, I was just thinking today about how these kids got into such a mess of trouble. I had to ask myself how far would I have gone, if in their shoes. I think there is a common factor here with the people posting here. And for the kids in the Manson Family. That is, a bad childhood. I could see myself migrating to a group like that. Getting into the drugs, getting into trouble and getting into the philosophy. Could I have killed???? I would hope not, but under that influence ie. drugs & worthlessness.. would I? Could I?

I am not saying I feel like they should be released or that I agree with the murders. I'm just wondering does anyone else wonder these things?

Yes, all the time and that is one of the main things that continues to fascinate me about this whole saga after so many years of reading and thinking about it.

I was only twelve years old when the murders occurred, but I was already infatuated with the whole hippie subculture and eventually became a hippie in my teen years.

Without a doubt, I tended toward the hero worship of a lot of the “counterculture” personalities at that time, and for one summer in 1974, even lived at a commune. When I was fifteen, I came into contact with the notorious hippie-Jesus freak group called The Children of God at an outdoor rock concert and was seriously considering leaving with them at the end of the show - due in no small part to all of the pretty hippie girls that were traveling with them - before my older brother managed to talk some sense into me.

I don’t now, nor have I ever had “murder in my heart,” as one prosecutor was fond of saying, but who knows what massive drug use, the promise of “free love” and a strong hatred of authority can do to a person?

No, you're not the only one. When I read the book Alone With The Devil (which is better than the sensational title would imply) by court psychiatrist Ronald Markman and read his statement "Every human being is capable of killing" I thought about it and came to the conclusion he's probably right.

Just look at the military. Young mommy's boys are turned into fearless killers who pull the trigger when they're told so without blinking an eye or losing any sleep over it.

IMO Charlie basically did the same kind of conditioning as the military does with its recruits, only more extreme. Would I have killed if I were in the same situation? I have no doubt I would.

When it comes to the possible release of Bobby (or Leslie), I think the media might indeed go rabid. But on the other hand, Leslie was out of prison in 1978 and as far as I've been able to establish nobody got their knickers into a twist back then, so maybe it won't be so bad. It has been 40 years, after all, and that's a very long time.

A fine post yepyep...which can lead to a discussion of whethrer or not people are born killers or their environment creates them...but I am tired..so right now I am gonna go pop in one of my favorite movies, Natural Born Killers, a great movie, and I remember seeing it in ther theatres...one of the movies I actually paid full price to see....

I wasn't impressed with that movie. Woody Harrelson was good but Juliet Lewis bothers me. She bothered me in "Cape Fear" (the remake) I like the movie "From Hell" starring Johnny Depp as the detective investigating the Jack The Ripper murders. He's such a good actor.

I heard that, but Depp decided not to do it because he thought he would wind up like Steve Railsback who played Manson in that old TV movie. Depp thought it would be a careeer killer -- Personally, I don't think Depp coul kill his career if he wanted to.

How odd, I have always thought a movie maybe called *BEFORE MANSON*
would make a great movie, just to show CM as a baby and how he was raised. His life from being Maddox to Manson, and how he got to Hollywood..how he was just following his mom. His life in several priosns he's been in , and also the the lives of the Hardcore Members, about how they were rasied and how they came into this circle . How they were very happy at one time just traveling around on the bus and singing. Living from every place fron San Fran to LA the Ranch. And life on the ranch before it all went bad.
I wrote CM once about a story about his life, his reply was that he didnt trust anyone to do it right. He said he only trusted one person at ONE time, to write a book and the guy *ucked it up. I guess he meant neul emmons?
But yea,
Depp would be the One to play CM!
And if it wasnt all about the MURDERS maybe Johnny Depp would agree. And so would CM. It's very hard for CM to trust very many people.( as he has been screwed over so many times) but then, ya never know.

I SO AGREE. I COULD BE A KILLER, IN A WAY THAT IF ANYONE HARMED MY FAMILY AS IN SO MANY MURDER CASES LIKE LACI PETERSON, OMG HAD THAT BEEN MY DAUGHTER AND I COULD HAVE GOTTEN TO PETERSON, I DONT THINK HE WOULD BE ALIVE TODAY.
THERES FIGHT OR FLIGHT ..I WOULD FIGHT.

share anymore than they have already. ;(
Blue still ( in her mind) lives in her world of how ownderful things were back then. I think she has resided on staying in that realm of her life. If you ask her today where she is, she will say * where she has always been*
CM's wife Rosie would have great imput on a book or film, she was close to Kathleen and the Maddox family to the end.

I would really love for them to write a book, but if Blue or Red want to hold those times close to their hearts and not, I respect that. They lived it, the good and the bad, struggled and came through..sometimes writing something and sharing things makes things lose their meaning..they were part of something we will never know, feel or understand,and if they want to keep it private, I can have nothing but the uttmost respect and love in my heart for that.

She is very smart. the hours we spent on the phone and things she talked about were WAY over my head. She was talking about everything from chemicals to Botony
to cooking. She's very intellent at certin things, the modern world she has left behind:) She still has her bike and still grow organic food.

I think she could write about what daily life was like with Charlie and what life on the road was like in the early days when the family traveled from place to place. She could her impressions about each member of the family and what she thought of them and maybe a few stories about some of them in terms of what it was like to live and interact among them.


Blue has done this, she has many journals. As to whom she leaves them to is her affairs.
I know not to mention the name Dianne Lake to her.

Hope all is well with him..and with Blue..I forget which interview slice but she gave the interviewer hell-it was for Hard Copy or something..I mean she tried to be nice to but the guy was acting like an idiot..then poof off she went...I was rolling-she gave it to him good.
Her journals are her journals and part of her heart..if she choses to share, great, if not, great..one must be careful with ones heart..and there are plenty out there who would take her words and try to destroy them..all I can say is shame on them, and karma karma...

yes Cat they would and already have. The site george set up for Sandy the ATWA site was taken by some guy called peter wentworth and he made a mockery of it and then signed his name as owner of the site. :(
I told George about it, but since the site was left for 4 years i think with no updates this guy was a pirate and took it over.
George is well! Doing Great:)
He has family near you also. Maybe it's time for that get together up there in Ohio.
This summer is great for me.Maybe around Sept?

At one of his trials, Beausoleil stated that he hadn't killed Hinman, Manson had. But in the OUI interview he said Manson wasn't even there. "You see the Sheriff's Homicide Department wanted to get Manson involved in my case, which was very difficult because Manson was not involved." Beausoleil continued and said that Hinman was killed because "he told me that he was going to the police (and tell them) that I had come and assaulted him to get money from him. I had my back against the wall."

I was thinking more on the lines of *The good ole daze*

Yes Kyra does have that classic chiseled look..But Reese has the sweetness and inner beauty ..that Sharon's friends and family remember most about Sharon.
